USTYLE Home Improvements – Terms and Conditions of Service (Supply and Fitting)

1. Definitions

  • “Company” refers to USTYLE Home Improvements.
  • “Client” refers to the individual or business purchasing goods and/or services from the Company.
  • “Goods” refers to all materials and products supplied.
  • “Services” refers to all fitting, installation, and related services provided.
  • “Contract” means the agreement between the Client and the Company for the supply and/or fitting of Goods and Services.

2. Scope of Work

  • The Company agrees to supply and/or fit the Goods as detailed in the written quotation or order confirmation.
  • Any changes to the agreed scope must be made in writing and may incur additional costs.

3. Quotations & Pricing

  • All quotations are valid for 30 days unless otherwise stated.
  • Prices are subject to change if the Client alters the scope or delays the start of the project beyond 60 days.

4. Payments

  • A deposit (typically 30%) is required upon acceptance of the quotation.
  • The balance must be paid upon completion of works or in accordance with the agreed payment schedule.
  • Late payments may incur interest at 2% per month and may result in work suspension.

5. Delivery & Installation

  • Delivery and installation dates are estimates only. While we strive to meet deadlines, the Company is not liable for delays caused by events beyond our control (e.g. supplier issues, weather, etc.).
  • The Client must provide access to the premises during normal working hours and ensure the area is ready and safe for work.

6. Client Responsibilities

  • The Client is responsible for securing any required permissions, permits, or approvals unless otherwise agreed.
  • The Client shall ensure utilities (electricity, water) are available during fitting works.
  • The Client must disclose any known issues (e.g. asbestos, electrical faults) prior to commencement.

7. Warranties

  • All Goods are warranted in accordance with manufacturer terms.
  • Fitting work is covered by a 12-month workmanship warranty unless otherwise stated in writing.
  • This warranty does not cover damage caused by misuse, neglect, or unauthorised alterations.

8. Cancellations & Refunds

  • Cancellations must be submitted in writing.
  • If work has commenced or materials ordered, the Client may be liable for costs incurred to date.
  • Custom-made or specially ordered items are non-refundable.

9. Limitation of Liability

  • The Company shall not be liable for indirect or consequential loss.
  • Total liability shall not exceed the value of the Contract.
  • Nothing in these terms limits liability for death or personal injury caused by negligence.

10. Termination

  • The Company reserves the right to terminate the Contract if:
    • The Client fails to make payments on time.
    • The Client breaches any terms herein and fails to remedy within 7 days.
    • The worksite becomes unsafe or access is denied.

11. Dispute Resolution

  • Any disputes will first be addressed through good faith discussions.
  • If unresolved, the parties agree to mediation before pursuing legal action.

12. Governing Law

  • These Terms and Conditions are governed by the laws of [Insert jurisdiction – e.g., England and Wales].

13. Entire Agreement

  • These Terms, along with the quotation and any agreed variations in writing, form the entire agreement between the Client and the Company.

By agreeing to proceed with the works or submitting payment, the Client acknowledges they have read, understood, and accepted these Terms and Conditions.
